Both G.F.W. Hegel and Carl Schmitt took seriously the problem of political sovereignty entailed by liberal political theories. In Dictatorship (1919) and Political Theology (1922), Schmitt rejects liberal political theories that argue for the immediate unity of democracy and legality i.e., popular sovereignty, because he thinks they cannot secure political sovereignty. In the Philosophy of Right, Hegel denounces popular sovereignty for similar reasons. Yet given Schmitt’s negative assessment of Hegel their positions are seldom related to one another. (...) I argue in this paper that Schmitt’s analysis of liberal political theories is similar to Hegel’s analysis of Rousseau’s liberal ideas. I contend, however, that Schmitt’s solution, which collapses the distinction between the executive and the legislative power in favor of the former, fails to secure political sovereignty. Contrary to Schmitt, Hegel conceives of the liberal predicament as a basic determination of any political state that rests on the division of the legislative and executive power. Hegel argues that the constitutional monarchy is a genuine instantiation of political sovereignty that can maintain not only the division of these powers, but also their unity. In this regard, I argue that Hegel’s conception of the division of powers provides a more convincing theory of the problem afflicting modern states than Schmitt’s and at least deserves to be taken more seriously by critics of Schmitt’s solution such as Hannah Arendt, Leo Strauss, Jurgen Habermas, Andreas Kalyvas and Chantal Mouffe. Faced by the challenge of religious plurality, most philosophers of religion view pluralism and exclusivism as the most accepted and fully developed positions. The third alternative, the model of inclusivism, held especially within the Catholic tradition, has not received adequate attention in the debates in philosophy of religion, perhaps as it is based solely on theological grounds. In this essay I offer a philosophical defense of the position of religious inclusivism and give reasons why this position represents the most appropriate (...) position in the face of conflicting religious truth claims. Why do we so often care about the outcomes of games when nothing is at stake? There is a paradox here, much like the paradox of fiction, which concerns why we care about the fates and threats of merely fictional beings. I argue that the paradox threatens to overturn a great deal of what philosophers have thought about caring, severing its connection to value and undermining its moral weight. I defend a solution to the paradox that draws on Kendall Walton's (...) solution to the paradox of fiction, developing his idea that it be extended to games. The solution takes games to involve make‐believe: in particular, players and spectators make‐believe that the outcome of the game matters. I also explore how the phenomenon extends beyond games. And I explore some moral implications: in particular, my view preserves the idea that we have reason not to impede others in their pursuit of what they care about. (shrink)

According to orthodoxy, the most fundamental kind of causation involves one event causing another event. I argue against this event‐causal view. Instead, the most fundamental kind of causation is thing causation, which involves a thing causing a thing to do something. Event causation is reducible to thing causation, but thing causation is not reducible to event causation, because event causation cannot accommodate cases of fine‐grained causation. I defend my view from objections, including C. D. Broad's influential “timing” argument, and I (...) conclude with implications for agent‐causal theories of free will. (shrink)

We argue that supererogation cannot be understood just in terms of reasons for action. In addition to reasons, a theory of supererogation must include prerogatives, which can make an action permissible without counting in favor of doing it.

This article aims to read feminist new materialisms (Barad), together with ‘postulated’ linguistic or cultural primacy of Queer Theory (Butler), to show how both are engaged in similar critical-ethical endeavours. The central argument is that the criticism of Barad and new materialisms misses Butler’s materialistic insights due to a narrow interpretation of Butler's alleged social-constructivist position. There is, therefore, a specific focus on where they both make similar ethical appeals. Moreover, the article relies on Adorno's negative dialectic to highlight an (...) interpretation of Barad and Butler as being part of the same dialectical movement, in which materialism and idealism fluctuate in their mutual criticisms, thus continuing the procession towards 'new knowledge' and emancipation, or freedom, through their motions back and forth. As health systems around the world turn towards highly distributed, specialized and cooperative structures to increase quality and safety of care as well as efficiency and efficacy of delivery processes, there is a growing need for supporting communication and collaboration of all parties involved with advanced ICT solutions. The Electronic Health Record (EHR) provides the information platform which is maturing towards the eHealth core application. To meet the requirements for sustainable, semantically interoperable, and trustworthy EHR solutions, different standards and different (...) national strategies have been established. The workshop summarizes the requirements for such advanced EHR systems and their underlying architecture, presents different strategies and solutions advocated by corresponding protagonists, discusses pros and cons as well as harmonization and migration strategies for those approaches. Ethical issues of information and communication technologies (ICTs) are important because they can have significant effects on human liberty, happiness, their ability to lead a good life. They are also of functional interest because they can determine whether technologies are used and whether their positive potential can unfold. For these reasons policy makers are interested in finding out what these issues are and how they can be addressed. The best way of creating ICT policy that is sensitive to ethical issues (...) would be to be proactive and address such issues at early stages of the technology life cycle. The present paper uses this position as a starting point and discusses how knowledge of ethical aspects of emerging ICTs can be gained. It develops a methodology that goes beyond established futures methodologies to cater for the difficult nature of ethical issues. The paper goes on to outline some of the preliminary findings of a European research project that has applied this method. (shrink)

The majority rule has caught much attention in recent debate about the aggregation of judgments. But its role in finding the truth is limited. A majority of expert judgments is not necessarily authoritative, even if all experts are equally competent, if they make their judgments independently of each other, and if all the judgments are based on the same source of (good) evidence. In this paper I demonstrate this limitation by presenting a simple counterexample and a related general result. Trust is generally held to have three different dimensions or aspects: a behavioral aspect, a cognitive aspect, and an affective aspect. While t here is hardly any disagreement about trusting behavior, there is some disagreement as to which of the two other aspects is more fundamental. After presenting some of the main ideas concerning the concept of trust as used in the analysis of social cooperation. I will argue that affective aspects of trust must be included in any adequate account (...) of the role of trust in social dilemma situations involving multiple equilibria. Cooperation in such situations requires coordination even though information on what another player might do is not available. A trusting person can handle such problems of cooperation by framing the situation in a way that goes beyond cognitive trust and solves what I shall call the problem of normative consent. I will conclude with some remarks ab out the design of institutions that foster trustful cooperation, especially in the context of the Internet. (shrink)

In contrast to Axelrod’s advice “don’t be envious” it is argued that the emotion of envy may enhance cooperation. TIT FOR TAT does exhibit a certain degree of envy. But, it does so in inconsistent ways. Two variants of TIT FOR TAT are introduced and their strategic properties are analyzed. Both generate the very same actual play as TIT FOR TAT in a computer tournament without noise. However, if noise is introduced they display some greater degree of stability. This is (...) due to the fact that they form, in a prisoner’s dilemma supergame with suitable parameters, an equilibrium with themselves that is subgame perfect or (in case of the first strategy) close to subgame perfect. It is additionally argued that these strategies are exceptionally clear and comprehensible to others in that they conform to well known real live behavior patterns. (shrink)

With increasing complexity of the networks of social interaction new and more abstract forms of trust are in need. A conceptual analysis of different forms of trust, namely interpersonal trust, trust in groups and institutional trust is given. It is argued that institutional trust cannot totally replace interpersonal trust. Institutional trust rather builds on more personal forms of trust in that it is primarily formed in personal encounters with salient representatives of the institution and presupposes trust in others trusting in (...) the institution. Any form of trust is grounded in some normative foundation. A trusting person can make herself vulnerable to the action of other individuals because she perceives those others as acting from shared aims or values. Thus, some sort of virtue is a prerequisite of any form of genuine trust. While institutional trust may in some respect be more easily acquired than interpersonal trust in general it may bear a fundamental problem: institutional trust may be extraordinary robust with regard to a wide range of behavioral experiences; thus, it may be enduringly maintained although in fact unjustified. In a concluding section the general analysis is illustrated by some reflections on the problem of trust in government. (shrink)

Communication is an inherently strategic matter. This paper introduces simple game theoretic models of information transmission to identify different forms of uncertainty which may pose a problem of trust in testimony. Strategic analysis suggests discriminating between trust in integrity, trust in competence, trust in (the will to invest) effort and trust in honesty. Whereas uncertainty about the sender's honesty or integrity may directly influence a rational receiver's readiness to rely on sender's statements, neither uncertainty about the competence of a sender (...) nor uncertainty about his willingness to invest effort has any direct impact on rational reliance on its own. In this regard, trust in honesty and trust in integrity appear to be more basic than trust in competence or effort. (shrink)

Naturalism, as Binmore understands the term, is characterized by a scientific stance on moral behavior. Binmore claims that a naturalistic account of morality necessarily goes with the conviction “that only hypothetical imperatives make any sense”. In this paper it is argued that this claim is mistaken. First, as Hume’s theory of promising shows, naturalism in the sense of Binmore is very well compatible with acknowledging the importance of categorical imperatives in moral practice. Moreover, second, if Binmore’s own theory of moral (...) practice and its evolution is correct, then the actual moral practice does-and in fact must-incorporate norms, which have the form of a categorical imperative. Categorical imperatives are part of social reality and, therefore, any (normative) moral theory that adequately reflects moral practice must also include categorical imperatives. (shrink)

Philosophers ask just whose expression, if anyone’s, we hear in lyric poetry. Walton provides a novel possibility: it’s the reader who “uses” the poem (just as a speech giver uses a speech) who makes the language expressive. But worries arise once we consider poems in particular social or political settings, those which require a strong self-other distinction, or those with expressions that should not be disassociated from the subjects whose experience they draw from. One way to meet this challenge is (...) to consider the poem expressive of a plural subject, which frees us from looking for a particular individual whose voice we hear in the work, whether she be fictional or actual. Some lyrics give voice to a group whose experience is attended to in the work. This may be done through a posited fictional speaker, but the ontology of the speaker is shown to be less important. Attending to a group whose concerns are voiced allows us to explain how poems can manage to address our-worldly concerns even when lacking actual persons whose expressions we encounter in the poems. A particular problem of traditional Rational Choice Theory is that it cannot explain equilibrium selection in simple coordination games. In this paper we analyze and discuss the solution concept for common coordination problems as incorporated in the theory of Team Reasoning (TR). Special consideration is given to TR’s concept of opportunistic choice and to the resulting restrictions in using private information. We report results from a laboratory experiment in which teams were given a chance to coordinate on a particular pattern (...) of behavior in a sequence of HiLo games. A modification of the stage game offered opportunities to improve on the team goal through changing this accustomed pattern of behavior. Our observations throw considerable doubt on the idea of opportunistic team reasoning as a guide to coordination. Contrary to what TR would predict, individuals tend to stick to accustomed behavioral patterns. Moreover, we find that individual decisions are at least partly determined by private information not accessible to all members of a team. Alternative theories of choice, in particular cognitive hierarchy theory may be more suitable to explain the observed pattern of behavior. (shrink)

A basic conviction in moral non-cognitivism is: only hypothetical norms may be justified. Hartmut Kliemt argues for a moderate variant: there are only hypothetical justifications of norms whether the norms are hypothetical or categorical in kind. In this paper the con- cept of ‘hypothetical justification’ is analyzed. It is argued that hypothetical justifications are not of the kind that we should look for in normative ethics.

Faith in the sense of trust in God is discussed as a somewhat extreme case of trust. Trust in general is understood as an emotional attitude and determined by the way a trusting person perceives the world and the person trusted. Interpersonal trust as the most common form of trust is characterized by connectedness - the trusted person is perceived as acting according to norms, values or goals shared by the trusting person - and by a participant attitude in the (...) sense of Strawson. Trust in God differs essentially from ordinary interpersonal trust, as the asymmetrical relationship between God and a faithful person does not allow for sharing a normative basis of conduct in the strict sense of „sharing“. Therefore, trust in God is ‚categorical‘ in character: the faithful person acknowledges God’s will as the ultimate and binding standard of normative value. Whatever happens, the faithful person perceives it as an expression of God’s will, and, thus, as ‚good‘. (shrink)

When it comes to evaluating reductive hypotheses in metaphysics, supervenience arguments are the tools of the trade. Jaegwon Kim and Frank Jackson have argued, respectively, that strong and global supervenience are sufficient for reduction, and others have argued that supervenience theses stand in need of the kind of explanation that reductive hypotheses are particularly suited to provide. Simon Blackburn's arguments about what he claims are the specifically problematic features of the supervenience of the moral on the natural have also been (...) influential. But most discussions of these arguments have proceeded under the strong and restrictive assumptions of the S5 modal logic. In this paper we aim to remedy that defect, by illustrating in an accessible way what happens to these arguments under relaxed assumptions and why. The occasion is recent work by Ralph Wedgwood, who seeks to defend non-reductive accounts of moral and mental properties together with strong supervenience, but to evade both the arguments of Kim and Jackson and the explanatory challenge by accepting only the weaker, B, modal logic. In addition to drawing general lessons about what happens to supervenience arguments under relaxed assumptions, our goal is therefore to shed some light on both the virtues and costs of Wedgwood's proposal. Through a thematic analysis, this paper deconstructs silence into various dimensions—its ontology, linguistic universality, and its function as cessation of speech, a form of listening, an act of kenosis, a form of ascesis, and a way of life. The study employs philosophical discourse and mathematical notation to delve into these aspects, demonstrating that while each perspective sheds (...) light on certain facets of silence, none can comprehensively encapsulate its essence. The research underscores the paradoxical nature of silence. It is both a universal phenomenon recognised across cultures and an intimate, personal experience that resists definitive categorisation. The paper concludes that the true nature of silence, particularly when considering the state of "being silent," remains indefinable and elusive, inviting deeper contemplation on its role in human experience. In this article, I explain how and why different attempts to defend absolute divine simplicity fail. A proponent of absolute divine simplicity has to explain why different attributions do not suppose a metaphysical complexity in God but just one superproperty, why there is no difference between God and His super-property and finally how a absolute simple entity can be the truthmaker of different intrinsic predications. It does not necessarily lead to a rejection of divine simplicity but it shows that we (...) may consider another conception of divine simplicity compatible with some metaphysical complexity in God. A liberalism which scorns all individualism is fundamentally misguided. This is the chief thesis of this paper. To argue for it, I look closely at some key concepts. The concepts of morislity and individualism are crucial. I emphasize Dewey on the "individuality of the mind" and a Deweyan discussion of language, communication, and community. The thesis links individualism and liberalism, and since appeals to liberalism have broader appeal in the present context of discussions, I start with consideration of liberalism. The (...) aim is to dispute overly restrictive conceptions and explore a broader perspective. To bring the argument to a close, attention turns first to Dewey on value inquiry, to Dewey's "democratic individualism" (cf. Dewey 1939, 179), and to the concept of moral community. Disputing the acquisitiveness of utilitarian influences in classical liberalism, a Deweyan argument from the nature of moral community supports re-emphasis on individualism in contemporary liberal thought. This classic collection of essays, first published in 1968, represents H.L.A. Hart's landmark contribution to the philosophy of criminal responsibility and punishment. Unavailable for ten years, this new edition reproduces the original text, adding a new critical introduction by John Gardner, a leading contemporary criminal law theorist.

Based on the Aristotelian dynamis-energeia-differentiation, a concept issuing dynamic coherence providers as the sub-level of individual realizations. This logical sub-level is given for any kind of realizations. Based on this two-level approach, to some degree similar to the two-level approach developed by Polanyi, model of biopsychosocial interaction is established. It is suggested as the theoretical basis for a person-centered approach in healthcare, integrating science and humanitites.

L’objectif de cet article est de comprendre l’importance de la métaphysique analytique pour le travail philosophique et pour l’enseignement dans le contexte français. Pour cela, je commencerai par exposer ce qu’il faut entendre par métaphysique analytique, puis j’examinerai plusieurs conditions de possibilité de la métaphysique analytique en France : la relecture de l’histoire de la métaphysique, des découvertes en logique, une réflexion sur l’objectif et un examen rapide des conditions matérielles et sociales d’enseignement et de recherche.

L’article interroge successivement l’éthique intellectuelle centrée sur les vertus et défendue par Roger Pouivet et celle centrée sur les normes rationnelles de la croyance défendue par Pascal Engel. En plus de thèmes propres à chaque éthique, on insistera sur la confrontation métaphysique au naturalisme ainsi que sur le possible caractère tragique de l’éthique intellectuelle. Ces exigences intellectuelles risquent de mener à des formes de mélancolie ou de misanthropie, sauf si l’éthique intellectuelle est solidement associée à une espérance religieuse ou rationnelle (...) qui n’est peut-être pas vraiment compatible avec ces mêmes exigences. Pour penser philosophiquement les attitudes religieuses, le concept de croyance est parfois considéré comme inadéquat. Un des reproches souvent développés est qu’une croyance propositionnelle, croire que p, est une attitude trop théorique qui ne peut rendre compte de la foi et de la vie religieuse en général. Il est possible de répondre à ces objections mais cet article évalue la pertinence d’un concept apparemment plus fructueux : l’acceptation. According to the orthodox treatment of risk preferences in decision theory, they are to be explained in terms of the agent's desires about concrete outcomes. The orthodoxy has been criticised both for conflating two types of attitudes and for committing agents to attitudes that do not seem rationally required. To avoid these problems, it has been suggested that an agent's attitudes to risk should be captured by a risk function that is independent of her utility and probability functions. The main (...) problem with that approach is that it suggests that attitudes to risk are wholly distinct from people's (non-instrumental) desires. To overcome this problem, we develop a framework where an agent's utility function is defined over chance propositions (i.e., propositions describing objective probability distributions) as well as ordinary (non-chance) ones, and argue that one should explain different risk attitudes in terms of different forms of the utility function over such propositions. ABSTRACT Offsetting is a very ineffective way to do good. Offsetting your lifetime emissions may increase aggregated life expectancy by at most seven years, while giving the amount it costs to offset your lifetime emissions to a malaria charity saves in expectation the life of at least one child. Is there any moral reason to offset rather than giving to some charity that does good so much more effectively? There might be such a reason if your offsetting compensated or somehow (...) benefitted the victims of your emission, since that could mean that you would satisfy the duty not to harm others by emitting and offsetting. But that is typically not true. If your emission harms some person and your offsetting benefits some person, then these are most likely different people. Hence, I conclude, we have a stronger reason to give to effective charities than we have to offset our emissions. (shrink)

L’épistémologie des croyances religieuses qui pose la question de la rationalité des croyances peut être mise en question en introduisant des éléments de sciences sociales des religions et vice-versa. Un modèle épistémologique souligne que les croyances peuvent être garanties sans examen réflexif de la part du croyant. Mais dans un contexte pluraliste où la croyance particulière est mise en débat, l’exigence critique d’examen est une condition nécessaire de rationalité. En cela, l’épistémologie retrouve certains aspects de la sociologie de la critique (...) dans sa compréhension des manières de croire. Cependant, l’épistémologie dépasse l’approche de la sociologie pragma- tique car elle ne renonce pas à l’évaluation de la rationalité des croyances religieuses en évaluant les arguments pro et contra. Dans cette contribution, j'examinerai l'argument qui renvoie dos à dos le théisme et l'athéisme et qui structure la présentation de l'alternative que constitue le Dieu à venir. N'étant ni adhérant, ni sympathisant du réalisme spéculatif, je ne proposerai pourtant pas de critique externe de la philosophie de la religion proposée par Meillassoux. De manière heuristique, je vais tenir pour acquis Après la finitude et je montrerai ce qui me semble être les faiblesses de l'argument, critiques rendant finalement peu crédible l'affirmation (...) que peut encore venir un Dieu qui ne serait ni le Dieu métaphysique, ni le Dieu du sentiment religieux. Pour cela, je vais reprendre le dilemme spectral (Meillassoux) et discuter la cohérence du concept de Dieu à venir ainsi que sa pertinence pour résoudre le dilemme. Il apparaitra alors que si l'on admet la contingence absolue, on ne peut croire raisonnablement en un Dieu, même à venir. D'où le désespoir absolu. (shrink)

Some theists have adopted materialism for human persons. They associate this metaphysics with their belief in resurrection and focus on problems arising from personal identity, temporal gaps or material constitution, but, in this paper, I argue that being a materialist for human persons leads to an epistemological problem regarding our knowledge of God’s life. The only way to avoid this problem is to choose a particular materialist metaphysics for human persons, that is, a constitution theory that emphasizes the irreducibility of (...) the first-person perspective. Hume’s chapter “Of Miracles” has been widely discussed, and one issue is that Hume seems to simply beg the question. Hume has a strong but implicit naturalist bias when he argues against the existence of reliable testimony for miracles. In this article, I explain that Hume begs the question, despite what he says about the possibility of miracles occurring. e main point is that he never describes a violation of the laws of nature that could not be explained by scientific (...) theories. Cette introduction vise à montrer l'ampleur des thématiques abordées de Parfit en les rattachant au projet d'une éthique rationnelle, tandis que le numéro dansson ensemble, sans prétendre être exhaustif, propose des présentations et discussions de différents éléments clefs de sa philosophie.

Some philosophers of fiction – most famously Jerold Levinson1 - have tried to argue that fictional narrators can never be identified with real authors. This argument relies on the claim that narration involves genuine assertion (not just the pretense of assertion that lacks truthfulness) and that real authors are not in a position to assert anything about beings on the fictional plain - given that they don’t rationally believe in their existence. This debate on the status of narrators depends on (...) the idea that fictional beings and beings in the real worlds reside, as it were, at different levels. The assumption that there is a gap separating the levels of fiction and reality serves as a rationale for the claim that real authors could not possibly be en rapport with the fictional characters that they create (e.g. entertain beliefs about them, etc.). On peut inscrire les travaux de Engel dans le sillage rationaliste des Pères de la philosophie analytique, mais après le tournant naturaliste opéré par Quine. Ce sont les diverses bonnes raisons, exposées de manière non systématique par Engel, d’associer naturalisme et rationalisme que je souhaite présenter tout en cherchant à identifier la difficulté constitutive de ce programme qui ne reçoit pas de solution complète: la normativité épistémique ne semble ni éliminable, ni correctement intégrée à ce programme.

David Lewis n’a pas développé de philosophie complète de la religion à proprement parler mais il s’est penché précisément sur différents thèmes religieux comme le rapport entre Dieu et le possible, l’argument ontologique ou la théodicée. Bien que dénuées de toute systématicité, les publications de Lewis sur le religieux défendent un athéisme très argumenté. L'article vise à montrer comment son athéisme s'articule à l'existence d'une pluralité de dieux.

On conçoit assez souvent l’espace public des discussions comme devant être neutre et par conséquent sans mention des croyances religieuses comme raisons justifiant une décision. La neutralité vise à garantir l’acceptabilité par tous d’une décision pouvant être contraignante. On montrera que l’on peut articuler raisons neutres et raisons religieuses à condition que les raisons neutres restent les raisons ultimes. Cela implique que les raisons religieuses correctement liées à des raisons neutres sont parfaitement légitimes pour justifier une décision politique ou publique.

Depuis plus d’une dizaine d’années, Albert Piette travaille à renouveler les méthodes et les concepts de l’anthropologie. Cette refondation s’appuie sur ses propres travaux empiriques, notamment sur le religieux, sur l’usage de méthodes plus pointillistes comme la photographie ou la description des détails, ainsi que sur des hypothèses relatives à la différence entre Sapiens et Néandertal. Les nouvelles propositions de travail qu’il avance empruntent souvent à la philosophie comme moyen d’une réflexion épistémologique, mais aussi parfois à la métaphysique. C’est pourquoi (...) je me propose de discuter en philosophe son ouvrage Contre le relationnisme. Lettre aux anthropologues. Il ne s’agit pas de réactiver la pratique philosophique de la science ultime couronnant les autres disciplines grâce à une réflexivité plus radicale, mais de suivre la démarche de Piette dans ses motivations profondes qui, comme il l’admet lui-même, l’oblige à passer par la philosophie.
